Abstract

Während mit dem Ausdruck „Die Anderen“ im katholischen Kirchenrecht z.B. auch nichtkatholische Christen gemeint sein könnten, befasst sich der Autor hauptsächlich mit den Ungetauften. Ausgehend von ihrer theologischen Einordnung umreißt er ihren Rechtsstatus zunächst allgemein, um dann genauer auf das Eherecht und das Eheprozessrecht einzugehen. In der Folge des II. Vatikanischen Konzils verbesserte sich ihre Stellung. Sie werden als Rechtssubjekte mit ihrer eigenen Rechtstradition geachtet, wobei das Konzept des göttlichen Rechts als verbindendes Element gesehen wird. Schließlich überlegt der Autor, inwiefern die rechtlichen Regelungen den Prinzipien der Gleichbehandlung und der Reziprozität sowie dem Ziel des friedlichen Zusammenlebens genügen.
