Abstract

Im Beitrag werden die epistemologischen und empirischen Quellen des Kanonischen Rechts dargestellt und analysiert. Es wird sowohl das Verhältnis von ius scriptum und ius non scriptum innerhalb der empirischen Quellen bestimmt wie auch der systematische Wandel vom case law zur Kodifikation innerhalb der epistemologischen Quellen problematisiert. Aus rechtstheoretischer Perspektive ergänzen die Autoren die genannten Quellen um die neue Kategorie der ontologischen Quellen, die das Wesen des Kanonischen Rechts bestimmen. Diese werden als Ergänzung zum wahren Rechtscharakter des Kanonischen Rechts verstanden, als das antekanonistische theologische Vorzeichen des kirchlichen Rechtssystems. Darauf aufbauend charakterisieren die Autoren das Kanonische Recht als ordinatio rationis et ordinatio fidei und fordern eine anthropologische Wende in der Kirchenrechtswissenschaft im Sinne des obersten Gesetzes des kirchlichen Rechts – der salus animarum (c. 1752 CIC).

This article presents and analyses the epistemological and empirical sources of canon law. The relationship between the ius scriptum and the ius non scriptum within the empirical sources is determined, and the systematic change from case law to codification within the epistemological sources is problematized. From a legal-theoretical perspective, the authors add a new category of ontological sources to these, which determine the essence of canon law. They are understood as supplementing the true legal character of canon law, as the antecanonistic theological sign of the ecclesiastical legal system. Building on this, the authors characterize canonical law as ordinatio rationis et ordinatio fidei and call for an anthropological turn in ecclesiastical jurisprudence in the sense of the supreme law of ecclesiastical law – the salus animarum (c. 1752 CIC).
