Abstract

In den letzten Jahren ist eine verstärkte Aufmerksamkeit an der oder vielmehr an den vielfältigen jüdischen Rechtsdiskursen zu verzeichnen. Es wird dabei häufig davon ausgegangen, dass die jüdische Rechtstradition sowohl aufgrund einiger der religiösen Motive, die man vielleicht zum theologischen Kernbestand des Judentums rechnen darf, als auch als Resultat der spezifischen religionssoziologischen Bedingungen, unter denen sie sich entwikkelt und weiterentwickelt hat, auch für andere Kontexte – etwa rechtswissenschaftliche, philosophische, politische und literaturwissenschaftliche – einen hoch fruchtbaren Untersuchungsgegenstand abgibt.

In recent years we have seen increasing attention being paid to Jewish legal discourse, or rather to Jewish legal discourses in all their variety. It is often assumed that the Jewish legal tradition, partly because of some of the religious motifs that we can perhaps justifiably regard as forming the theological core of Judaism, and partly also as a result of the specific religio‐sociological conditions under which it has developed and redeveloped, will also provide a highly fruitful subject for investigation for other contexts – such as legal science, philosophy, politics and literature.
