Synthese und weiterführende Reflexionen zur Vortragsreihe

Der vorliegende Beitrag enthält eine Synthese und weiterführende Reflexionen zur Vortragsreihe „Das Recht der Religionen vergleichen: verschiedene Ansätze und Methoden“ und bildet damit den Abschluss des vorliegenden Special issue der Zeitschrift „Ancilla iuris“. Er befragt die einzelnen Beiträge darauf hin, wie sie das religiöse Recht verstehen und welche methodischen Ansätze zur Vergleichung sie skizzieren. Dazu greift er auch auf weitere Publikationen der Vortragenden sowie ergänzende Literatur im Umfeld der Thematik zurück. Er zeigt auf, wo Übereinstimmung und wo Divergenzen bestehen. Überraschend haben sich mehrere Vortragende unabhängig voneinander auf die Systemtheorie Niklas Luhmanns bezogen. Außerdem versucht der Beitrag, einzelne Überlegungen weiterzuspinnen und miteinander in Beziehung zu bringen. So wird sichtbar, in welche Richtung die Forschung auf diesem Gebiet weitergehen könnte.

Synthesis and further reflections on the lecture series

This article contains a synthesis and further reflections on the lecture series “Comparing the Law of Religions: Different Approaches and Methods” and thus forms the conclusion of this special issue of the journal “Ancilla iuris”. It examines the individual contributions in terms of how they understand religious law and which methodological approaches to comparison they outline. To this end, it also draws on other publications by the contributors as well as supplementary literature in the field. It shows where there is agreement and where there is divergence. Surprisingly, several speakers referred independently to Niklas Luhmann’s systems theory. In addition, the contribution attempts to expand on individual considerations and relate them to each other. In this way, the direction in which research in this field could continue becomes visible.
